Terms of Service

These Terms of Service ("Terms") govern your use of the FluentPro mobile application ("App") operated by Learnly Labs ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using FluentPro, you confirm that you:

  • Are at least 18 years old (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into these Terms
  • Agree to be bound by these Terms and our Privacy Policy

If you do not agree to these Terms, you must not use the App.

2. Description of Service

FluentPro is a professional English language learning application designed for IT professionals. The Service includes:

  • Structured learning modules with lessons and phrases
  • Interactive quizzes (multiple choice, fill-in-the-blank, scenario-based)
  • Spaced repetition flashcard review system
  • Progress tracking with streaks and learning goals
  • Bookmarking and content search
  • Cross-device synchronization
  • Push notification reminders

3. Account Registration

3.1 Account Creation

You must sign in using Google Sign-In to use the App. You are responsible for maintaining the security of your Google account credentials.

3.2 Account Accuracy

You agree to provide accurate information and to keep your profile information up to date.

3.3 Account Security

You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.

4. Subscription and Payments

4.1 Free and Premium Content

FluentPro offers both free content and premium content available through a paid subscription.

4.2 Subscription Plans

  • Monthly: $9.99/month (INR 499/month)
  • Yearly: $79.99/year (INR 2,999/year)

Prices may vary by region and are subject to change with notice.

4.3 Payment Processing

All payments are processed through the Apple App Store or Google Play Store. We do not directly collect or store your payment information. Billing is handled according to the respective platform's terms.

4.4 Subscription Management

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your device's app store settings.
  • No refunds are provided for partial billing periods, except as required by applicable law or platform policies.

4.5 Premium Features

Premium subscribers receive access to:

  • All learning modules
  • Unlimited quizzes
  • Offline access to content
  • Advanced analytics
  • Priority support

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Circumvent or disable any security features or subscription restrictions
  • Share your account credentials with others
  • Use automated systems or bots to access the App
  • Interfere with or disrupt the App's infrastructure
  • Copy, reproduce, or distribute the App's content without authorization
  • Misrepresent your identity or impersonate others

6. Intellectual Property

6.1 Our Content

All content in the App — including lessons, phrases, quizzes, illustrations, icons, and UI design — is owned by Learnly Labs or its licensors and is protected by copyright and intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial learning purposes, subject to these Terms.

6.3 User Content

Content you create within the App (such as bookmarks, goals, and support messages) remains yours. By submitting content through the App, you grant us a limited license to store and process it to provide the Service.

7. Disclaimers

7.1 "As Is" Service

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Learning Outcomes

We do not guarantee specific learning outcomes, language proficiency improvements, or career advancement as a result of using the App.

7.3 Availability

We do not guarantee that the App will be available at all times. We may perform maintenance or experience outages that temporarily interrupt service.

8. Limitation of Liability

To the maximum extent permitted by law, Learnly Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Account Suspension and Termination

9.1 By You

You may stop using the App at any time. You can request account deletion through the App's profile settings.

9.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Fail to pay subscription fees

We will provide reasonable notice before termination, except in cases of serious violations.

10. Changes to Terms

We may update these Terms from time to time. When we do, we will:

  • Update the "Last Updated" date
  • Notify you through the App
  • Request your acceptance of the updated Terms before you can continue using the App

If you do not agree to the updated Terms, you must stop using the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Learnly Labs is incorporated, without regard to conflict of law principles.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
